Confidentiality of private information related to our service and Customers is of utmost importance to us, therefore, we do our best, so you could feel safe while browsing our websites and using our services.

The privacy policy relates to any kind of private information and personal data collected via websites and our mailing lists, for the purposes for which the data was gathered and processed.

You can use our websites or related services and tools only if you have got acquainted with this Privacy Policy.

Please note that the privacy policy presented here differs depending on whether you have an account in our Online Store, or whether you are only a subscriber of our mailing lists (in which case the Online Store policy does not apply to you). Processing of personal data

For the proper execution of the sales contract, THEOGONIA RECORDS, Powstańców Śląskich 3A/27, 01-381, Warsaw, Poland, hereinafter referred to as the Seller, processes the personal data of the Customers, including first name, last name, address, date of birth, bank account no., e-mail address, and telephone number.

The Seller processes the personal data in compliance with the Personal Data Protection Act of the 29th of August 1997 and it is its controller in the understanding of the provisions of the regulation of the European Parliament and the Council (EU) of the 27th of April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing the Directive 95/46/EC.

The Seller applies, as required by the legal provisions, the technical and organizational security measures necessary to protect personal data processing and to secure the personal data against its disclosure to unauthorized persons, its acquiring by unauthorized persons, it’s processing, in particular, where the processing with violation of the Personal Data Protection Act, its alteration, loss or damage. Expressing consent to process the personal data by the Seller, in the understanding of the Personal Data Protection Act is voluntary, however failure to agree to personal data processing, prevents the execution of a transaction, delivery of an order, and any communication.

You have the right to review your data, correct and change it, as well as the right to request that its processing be stopped and the right to object to its processing for marketing purposes. The Seller is the personal data controller. The Seller processes the data to execute transactions and as regards the persons, who express consent to process personal data for marketing purposes – it also regards the own marketing of the Seller.

The Seller can entrust personal data processing with the entities cooperating with the Seller, within the scope necessary to execute transactions, e.g. in order to deliver shipments or to provide marketing information related to the Seller to these Customers, who have expressed consent to process their personal data for marketing purposes.

The Customer’s personal data shall not be sold to third parties, in particular, it shall not be transferred to other entities to send marketing materials to third persons.

Which data is processed

We shall process the following personal data:
• contact data, such as first and last name, address, e-mail address, and telephone number,
• information on payments and payment history,
• information on orders.

If you have an account in our Online Store, we will also process your personal data provided in relation to this account, inter alia:
• account identifier,
• purchase history.

Who has access to your personal data?

Your personal data, which is passed to external entities, is used only to provide the aforementioned services for you. The data is received by the companies, which confirm your address, communication agencies and courier companies, which deliver orders, companies executing payments, and debt collection companies.

The objective of personal data processing

The Customers’ personal data is processed by the Seller only within the scope necessary to
achieve the following objectives:
• providing the services available via the Seller’s website, including selling the goods offered by the Seller,
• creating and managing a Customer account,
• executing payments,
• handling the process of withdrawal, claim, and any possible pursuit of claims,
• marketing of the Seller’s products,
• sending a newsletter,
• organizing loyalty programs, competitions, and promotional activities, in which the Users can participate,
• executing a sales contract and shipping goods,
• handling Customers’ requests passed, in particular to the customer service department and via the contact form,
• performing obligations resulting from the legal provisions, including the tax or accounting laws,
• statistical,
• archiving,
• ensuring accountability.

The Customers’ personal data shall be kept for a period not exceeding the period when it is necessary to achieve the objective, for which it has been collected.

Cookies

If you leave a comment on our website you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Newsletter

Customers can subscribe to our newsletter by providing an e-mail address and express consent to process their personal data for marketing purposes and sending commercial information. We inform you about our new offers via newsletter. You can resign from the newsletter subscription at any time by clicking the link contained in the received newsletter.

Mailing List

If you sign up for THEOGONIA RECORDS mailing lists, we will collect your name and e-mail address. If you express consent to receive physical promotional materials, we will also collect your postal address. We use this personal data to send you press releases and promotional materials relating to our label and the artists that are signed to our label. From time to time, we also send you inquiries about press-related matters. We do not disclose your personal information nor do we sell it or make it available to any third party. We ensure your data is protected from unauthorized access. You have the right to request a copy of the information we hold about you. You can also request us to update your personal data, limit the processing of your personal data or delete the information we hold about you. Customer Account

While creating the Customer account, we ask for providing the following Customer’s data: first name, last name, e-mail address, telephone number, date of birth, and address. The following fields are required to register the Customer account: first name, last name, and email address.

We shall process the following personal data if you agree to provide it:
• contact data, such as first and last name, address, and telephone number,
• date of birth,
• country,
• account settings.

If you make a purchase, we shall process the following personal data:
• purchase history,
• information on delivery,
• payment history.

We shall also process the following personal data related to the cookies files:
• click history,
• navigation and browsing history.

Your personal data is processed upon the consent, which you express at the time of creating the account in the Online Store.

We process your personal data to provide you with interesting information about products, on the basis of our legitimate interest.

Notifying about the availability of a product

Upon your request, the Seller shall send information about product availability by electronic means. The condition for sending such information is to express consent to receive commercial information about the products from the Online Store on the e-mail address, you have provided and to process the personal data by the Seller. Data submission is voluntary, however, failure to express consent for personal data processing prevents sending information about product availability. You have the right to access your data and correct it.

Data protection

The Seller ensures that it shall do its best to process the personal data with the utmost respect for the privacy of persons, whose data is processed and with the highest care for the security of the processed personal data. In particular, the Seller guarantees that it has undertaken all measures provided for by legal provisions, which aim at securing data collections entrusted with it, in particular:
• it uses technical and organizational measures guaranteeing the protection of personal data processing adequate for risk and categories of data covered by the protection,
• secures the data against its disclosure to unauthorized persons, acquiring them by an unauthorized person, processing it with violation of the act, and its alteration, loss, damage, or destruction,
• conducts the documentation describing the manner of the data processing and the measures, referred to above,
• only selected persons allowed to process data, who have authorization granted by the Seller,
• guarantees control over the information, which personal data, when and by who has been added to the collection, and to whom it is transferred,
• keeps registers of persons authorized to process the personal data.

In particular, the Seller applies the following technical measures, which prevent obtaining access to information and personal data processed via the website by unauthorized persons:
• SSL protocol encryption,
• Amazon firewall systems.

The right to information and to withdraw the consent to process the data

You can contact us in writing or by e-mail to provide you with information free of charge regarding the personal data, which is collected and processed by the Seller. You can also withdraw your earlier consent to process your personal data and request that the processing of your personal data is stopped. Then we shall take measures necessary to stop the processing of your personal data immediately and free of charge and remove it from our databases. You have the right to access your personal data, and the right to request its clarification, deletion, or limitation of its processing on the conditions resulting from the Regulation.

You have the right to object to personal data processing in such a scope, in which the basis for the processing of your personal data is the condition of the legitimate interest of the Seller.

You have the right to withdraw your consent within the scope, which constitutes the basis for personal data processing. Withdrawing your consent has no impact on compliance with the processing, performed on the basis of the consent expressed before its withdrawal.

You also have the right to transfer personal data within the scope, in which your personal data is processed to conclude and execute a contract or processed under the consent, i.e. the right to receive the personal data from the Seller, in a structured, commonly used in machine-readable form (in this case the data can be sent to another data controller).

You have the right to object to the processing of your personal data for the needs of promoting and marketing of the activity conducted by the Seller, within the scope, in which your personal data is processed to promote and provide marketing of the activity conducted by the Seller, to such an extent, in which this processing is related to promotion and marketing of the activity conducted by the Seller.

You also have the right to lodge a complaint to the President of the Personal Data Protection Office in case there is a suspicion that processing of your personal data violates the provisions on personal data protection.

If it is necessary, the Seller can amend the provisions of the Privacy Policy. In this case, the provisions of the Terms and Conditions of the Online Store shall apply within the scope, in which they relate to the amendments in the Terms and Conditions.
